Last updated:
These terms govern every charter arranged through elarboldelaspalabras.es under the brand Ibiza Yachts for Rent, and every charter confirmed with us by email, phone or WhatsApp for a yacht based in Ibiza. They apply to the person or company named on the written quote and to every guest who boards under that booking.
By sending an enquiry, accepting a quote or boarding one of our yachts, the client accepts these terms. Where a point is not covered here, the written quote and confirmation sent for that specific charter prevail.

Scope and who we are
Ibiza Yachts for Rent is the trading name under which elarboldelaspalabras.es offers yacht and boat charter in Ibiza, Spain: crewed day charters and longer itineraries across around thirty vessels, from day-boats to superyachts, with day rates from €1,700. We act as the charter operator contracting directly with the client for the specific yacht and dates confirmed in writing.
All questions about an enquiry or an existing booking can be sent to [email protected].
From enquiry to confirmed booking
Nothing is booked automatically. A visitor submits the enquiry form, or contacts us by email, phone or WhatsApp, giving at least the desired dates, number of guests and, where known, the preferred yacht.
We reply with a written quote covering the yacht, dates, price and what is included. The charter becomes a confirmed booking only once that quote has been accepted and we have sent written confirmation. Verbal discussions, availability shown on the website or a quote sent but not confirmed do not themselves create a booking.
Prices and what is included
The price stated in the written quote is the full charter price for the yacht, dates and itinerary described in that quote, including crew unless stated otherwise.
Fuel, marina fees, the advance provisioning allowance (APA) on larger yachts, catering and any other extras are charged exactly as set out in the written quote. We do not add any cost to the final invoice that was not itemised in that quote.
Payment, deposit and the right of withdrawal
Booking is confirmed after full payment for day charters, or after a 50% deposit for longer charters. The remaining balance, where a deposit was paid, is due by the date stated in the written confirmation for that charter.
Under EU consumer law, the 14-day right of withdrawal that normally applies to distance contracts does not apply to leisure services booked for a specific date, under Article 16(l) of Directive 2011/83/EU, reflected in Spain at Article 103(l) of Royal Legislative Decree 1/2007. A charter booked for a given date and yacht cannot be withdrawn from free of charge during a statutory cooling-off period. In its place, the voluntary cancellation tiers set out below apply to every booking made through us.
Cancellation and changes by the client
A client who cancels a confirmed charter is refunded according to how far ahead of departure the cancellation reaches us in writing:
- more than 7 days before departure: full refund
- between 48 hours and 7 days before departure: 50% refund
- less than 48 hours before departure: no refund
Refunds due under these tiers are processed within 14 business days to the original payment method. A request to move a confirmed charter to a different date is treated as a cancellation of the original date and a new booking, unless we agree in writing to reschedule it without applying these tiers.
Cancellation or alteration by us
If the captain or the relevant port authority considers conditions unsafe for the planned charter, whether for weather, sea state, a technical issue with the yacht or another safety reason, the client chooses between a free new date and a full refund. We do not offer a partial refund in this situation; it is one or the other.
The captain's decision on safety is final and cannot be overridden by the client or by us. The same approach applies where a charter cannot go ahead because of force majeure, including port closures, official restrictions or events beyond our control.
Guest capacity, the captain's authority and conduct on board
The number of guests on board may never exceed the yacht's licensed capacity as stated in the quote. Crew may refuse boarding to anyone whose presence, number or condition would put the vessel, crew or other guests at risk.
Once under way, the captain has full authority over the safety of the yacht, crew and guests, including the itinerary actually sailed on the day. A route discussed in advance is indicative; the captain may shorten, extend or change it in response to weather, sea conditions, port instructions or guest safety, without this being treated as a breach of the booking.
Guests are expected to follow the crew's safety instructions at all times, including on swimming, tender use, water sports and alcohol consumption on board. The crew may end a charter early, without refund for the time remaining, if a guest's conduct endangers the vessel or any person on board.
Damage, personal belongings and liability
The client is responsible for damage to the yacht, its tender, equipment or fittings caused by a guest's negligence or by conduct contrary to the crew's instructions, beyond normal wear from the charter as quoted.
Personal belongings brought on board remain the guest's own responsibility; we do not accept liability for their loss, theft or damage, except where that loss or damage results directly from our negligence or that of the crew.
Our liability for a charter is limited to the price paid for that charter, except where liability cannot lawfully be limited, such as for death or personal injury caused by our negligence. We are not liable for losses caused by circumstances beyond our reasonable control, including the weather and safety situations described above.
Complaints, website use and content
Any complaint about a charter should be sent to [email protected] as soon as possible, ideally before disembarking so the crew can address it on the day; we respond to written complaints within a reasonable time after receiving them.
The website's descriptions, photographs and yacht listings are provided to help plan a charter and are updated as yachts and availability change; the written quote for a specific charter prevails over any general description on the site. Content on elarboldelaspalabras.es, including yacht descriptions and images, belongs to Ibiza Yachts for Rent or its licensors and may not be copied or reused without permission.
Governing law, jurisdiction and changes to these terms
These terms and every charter booking made under them are governed by Spanish law. Disputes are submitted to the courts of Ibiza, Spain, save where a consumer is entitled under Spanish law to bring proceedings before the courts of their own domicile instead.
We may update these terms for future bookings; the version in force at the time a charter is confirmed in writing applies to that charter. Current terms are always available at elarboldelaspalabras.es.
